I think that you're misinterpreting a warning of an impending lawsuit as whining. This statement is a clear warning:

If Michael Moore had made demonstrably false statements about Bush then he would have had standing to issue a similar warning and Moore would have had a duty to act or he would have risked legal liability.

Oh, bullshit...this guy doesn't even claim this to be a documentary. It's ok to make movies about assassinating Bush and how Cheney will invade Cuba and then say that Bush put dynamite in the WTC on 9/11 to make the towers fall.
