ORDINANCE 2005-20 AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER XVI POLICE REGULATIONS OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF BELMAR, IN THE COUNTY OF MONMOUTH, NEW JERSEY WHEREAS, the Borough of Belmar now desires to amend and supplement specific provisions with regard to alcohol related games and contests under new Section 16-25 of the Borough of Belmar Revised General Ordinances; and WHEREAS, Belmar is a family community and a popular tourist destination for families, and is visited each summer by tens of thousands of families with children, many of whom either park in the residential neighborhoods to walk to the beach, or to attend events in the community, or to visit friends or relatives; and WHEREAS, municipal officials and residents have taken notice of the increasing frequency of occasions on which occupants of summer rental properties in the community have begun engaging in games and contests on their lawns and porches that involve as an element of the game or contest the consumption or use of alcoholic beverages; examples of same games are Beer Pong and chugging contests; WHEREAS, the Mayor and Council find that the playing of such outdoor alcohol related games and contests can expose these families and their impressionable children to foul language, rowdy and disorderly behavior and to examples of the consumption of alcohol under circumstances that are detrimental and to which they ought not to be exposed, and that can adversely affect the health, safety and welfare of these children, their families and the general public. NOW, THEREFORE, BE IT ORDAINED by the Borough of Belmar, County of Monmouth, New Jersey, that Chapter XVI Police Regulations of the Borough of Belmar Revised General Ordinances is hereby amended and supplemented as follows: SECTION I. Chapter XVI Police Regulations is hereby amended as follows: [Note to Editor: Section 16-25 is new but is not underlined for ease of reading.] 16-25 Games and Contests Involving the Consumption of Alcohol. 16-25.1 No game or contest that involves as an element of the said game or contest the consumption or use of an alcoholic beverage shall be permitted, performed or engaged in outside of a house, building or other structure in such a location and/or manner that they can be viewed from a public street, public sidewalk or other public thoroughfare, or from an adjacent property. This includes, but is not limited to: front yards, side yards, porches or decks. 16-25.2 Violations - Penalties. Any person violating the provisions of this Section shall upon conviction thereof, be subject to a fine of: 1. One Hundred dollars ($100.00) plus costs for a first offense; 2. Two Hundred Fifty ($250.00) plus costs for a second offense; 3. Five Hundred dollars ($500.00) plus costs for a third and subsequent offenses. SECTION II. If any section, paragraph, subdivision, clause or provision of this ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph, subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed valid and effective. SECTION III. All Ordinances or parts of ordinances inconsistent with or in conflict with the ordinance are hereby repealed to the extent of such inconsistency. SECTION IV. This Ordinance shall take effect 20 days after final passage, adoption and publication according to law. |
